In the UK, companies are most commonly wound up because they are the subject of a winding up petition and unable to pay their creditors. This situation brings about a compulsory liquidation and requires subsequent investigations by the Official Receiver. A Creditor’s Voluntary Liquidation (CVL) can be preferable for directors but it requires foresight and a company to be taken voluntarily into liquidation.
A third form of liquidation that is commonly used in the UK is referred to as a Members’ Voluntary Liquidation (MVL), which is generally a cost-effective means of winding up a solvent business.
