Compulsory liquidation is the most common form of the process in the UK and it tends to result from a situation in which an unhappy creditor has pursued a winding up order against a debtor. Investigations by the Official Receiver tend to be necessary where a business has been forced into liquidation in this fashion.
Voluntary entry into liquidation is generally recommended as best practice in a situation whereby a company has become insolvent and unable to pay its debts. We can advise directors on all matters relating to Creditors’ Voluntary Liquidation (CVL) processes and Members’ Voluntary Liquidations (MVLs), which are designed to function as a tax-efficient means of closing down a solvent company through liquidation.
