If your business is in serious arrears with creditors, you may be in the firing line of being forced into compulsory liquidation as a result of legal action. Creditors commonly attempt this route to recoup outstanding funds, however, failure to make the payment or arrive at an agreement during the early stages of the process could result in the forced closure of your company.
Creditors’ Voluntary Liquidation (CVL) is a formal insolvency procedure entered into voluntarily. This route is typically taken following the accumulation of debt over a series of months, or even years. By entering a Creditors’ Voluntary Liquidation, you can settle outstanding affairs with creditors which may result in the remainder of your debt to be written off upon liquidation. Your company will then be closed and removed from the Companies House register.
If you wish to liquidate a profitable business, a Members’ Voluntary Liquidation (MVL) may be suitable for your company. An MVL is a formal insolvency process administered by a licensed insolvency practitioner. Once creditor affairs have been settled, retained profits will be distributed to shareholders in a tax-efficient manner and the company will then be closed.
